Media Advisory: SAHRC to engage with Water Services Authorities in Mpumalanga

Water is central in leading a life with dignity. The Constitution of the Republic of South Africa, 1996 in section 27(1)(b) entrenches the right to have access to sufficient water.  Municipalities which are designated as Water Services Authorities (WSAs) in terms of the Water Services Act 108 of 1997 play a crucial role in providing water. Unfortunately, some WSAs in the country are severely challenged and struggle to fulfil this important constitutional and statutory obligation of providing water to all households within their jurisdictions.

The South African Human Rights Commission (Commission) in furtherance of its mandate to protect the right to water has conducted several investigative inquiries in the provinces of KwaZulu Natal, Limpopo and Mpumalanga. These inquiries have all found that factors such as lack of sufficient skills; lack of planning; cost recovery model; and lack of proper execution of duties as required by the Water Services Act are some of the underlying root causes inhibiting WSAs from complying with their constitutional and statutory obligations.

In the spirit of a constitutional dialogue and in exercising cooperative control, the Commission has partnered with the University of Witwatersrand (Wits University) in developing the South Africa Water Justice Tracker Project. The Water Justice Tracker will be a Geographic Information System based online tool containing information on the progressive realisation of the right to water by WSAs. The Water Justice Tracker will serve a dual role. Firstly, it will be an accountability mechanism enabling people to hold WSAs to account for their delivery on the right to water. Secondly, it will enable WSAs to introspect and take stock on how they are progressing in fulfilling the right to water.

Thus, as part of the Water Justice Tracker project, the Commission together with its partner, Wits University, will be holding a stakeholder engagement with all the seventeen WSAs in Mpumalanga. The stakeholder engagement will entail consulting with WSAs in Mpumalanga on the veracity and accuracy of the developed profiles.
