Release of report by the Marikana Commission of Inquiry

The South African Human Rights Commission welcomes the release of the Marikana Report by the President.  We are pleased that the President has taken the time to reflect on the findings and recommendations of the Marikana Commission of Inquiry and has provided a formal response to the nation.

The release was a long-awaited one. The right of individuals to access justice and the right to just administration are two clear rights entrenched in the Bill of Rights. Taken together, these rights include the right to be heard, to be represented, to obtain relief, and to be informed of the outcome of an adjudicatory process.

Reflecting on the statements made by President Jacob Zuma yesterday evening it appears as though the report has confirmed some of the main findings the SAHRC has proposed in its submission to the Marikana Commission of Inquiry.

The SAHRC, as a constitutional body seized with the responsibility of monitoring the realisation of human rights in the country, will now carefully consider the Marikana Report together with the President’s response to the findings and recommendations and will issue a formal statement in due course.
