IMPORTANT NOTICE: Private bodies exempted from compiling the Manual contemplated in Section 51(1) of PAIA for a period of five years with effect from 1 January 2016
The South African Human Rights Commission (the Commission) received notice on 26 November 2015 from the office of the Minister of Justice and Correctional Services confirming that the Minister has "decided to further exempt private bodies from compiling the Manual contemplated in Section 51(1) of PAIA for a period of five years with effect from 1 January 2016."
The notice of exemption is yet to be gazetted. The Commission will make same available as soon as it has been published.
Please see attached, the previous exemption notice which sets out which categories of private bodies must still comply with Section 51 of PAIA.
If your private body falls within the exemption and a manual has already been prepared in terms of Section 51 of PAIA, please note that there is no need to submit the manual to the Commission. We do however strongly encourage you to upload the manual on your website and ensure that same is available at your office/s for public inspection.

The South African Human Rights Commission (SAHRC) welcomes the judgment handed down yesterday by the Western Cape High Court in a matter relating to the lack of judicial oversight in the granting of emolument attachment orders (“EAOs”). The SAHRC intervened in the matter as amicus curiae, to champion the human rights of people who are poor and vulnerable. In handing down his judgment, Judge Desai placed on record the court’s ‘indebtedness to the amicus curiae and their counsel.’
