HRC will not proceed with complaint against Gail Johnson

The South African Human Rights Commission (SAHRC) received a complaint on the 15th of May from Ms. Hilda Khoza containing serious allegations against Ms Gail Johnson, the foster mother of Nkosi Johnson. The complainant’s allegations included the violation of Nkosi’s right to education as his foster mother allegedly kept him from school, his right to life as he was allegedly refused medical treatment, and his right to be protected from maltreatment, abuse, neglect, and degradation.

The SAHRC felt that the broad allegations brought forward by the complainant needed to be substantiated and therefore without delay arranged to meet with the concerned parties. In light of the tragic passing of Nkosi Johnson this morning the Commission could not meet with Gail Johnson. However a meeting with the complainant was held. On the basis of the discussions with the complainant this morning (1 May 2001) the Commission determined that there was no prima facie violation in the complaint as presented by the complainant. The Commission further recommended that the complainant publicly retract the unsubstantiated allegations made. In light of the discussion this morning the Commission will not proceed with this matter. This will be duly communicated to Gail Johnson.

The Human Rights Commission would also like to convey its deepest condolences to the Johnson family.
